Liability Waiver and Release for Podcast & Interviewer Training
Certain inherent risks are associated with participating in podcast and interviewer training that cannot be eliminated. These risks include, but are certainly not limited to:
(1) minor issues such as eye strain, vocal fatigue, emotional stress, or physical discomfort from extended use of recording equipment, and
(2) major risks such as repetitive stress injuries, psychological stress, or incidents arising from electrical equipment, trip hazards, or technical malfunctions.
Also included are risks that may result from the use of media equipment, studio spaces, the acts of others, or the unavailability of emergency care.
(Hereinafter, all such risks and potential harms shall be referred to collectively as the “Risks.”) These Risks are present during all training activities conducted by James Finlen, his family members, heirs, agents, and representatives, and at 103 Barnwell Avenue, Rincon, GA, 31326 (the “Activities”).

HAVING READ THIS PARAGRAPH and with a full understanding of these Risks, I affirm that my (and/or my minor’s) participation in these Activities is voluntary, and I agree on behalf of myself or my minor to the following:

1. ASSUMPTION OF RISK
I, on behalf of myself and/or my minor, ASSUME ALL RISKS associated with participating in the Activities, including but not limited to the use of audio/visual equipment, lighting, cables, digital software, interaction with others, and any unexpected issues that may arise while on-site at the property.

2. INDEMNITY / HOLD HARMLESS
I, on behalf of myself and/or my minor and/or our heirs, personal representatives, and assigns, agree to indemnify and hold harmless James Finlen, his family members, heirs, agents, representatives, and the property located at 103 Barnwell Avenue, Rincon GA, 31326—including any affiliates, contractors, producers, or investors involved in related marketing content or training operations—from any and all claims, legal actions, or liabilities arising from participation in the Activities.

I also grant permission for my and/or my minor’s image, voice, or likeness to be used in marketing, educational, or promotional content related to the training program, without expectation of future compensation.

3. RELEASE / WAIVER
In exchange for being allowed to participate in the Activities, I, on behalf of myself and/or my minor and our heirs and representatives, RELEASE AND WAIVE all claims against James Finlen and associated parties for any injury, property loss, or adverse outcome—anticipated or unanticipated—arising from the Activities.

4. NO INSURANCE
I acknowledge that James Finlen and his associates do not carry insurance on my behalf or that of my minor. I accept full financial responsibility for any costs resulting from injury, damage, or incidents occurring during the Activities.

5. LEGAL RIGHTS
I understand that by signing this agreement, I am voluntarily surrendering significant legal rights, including the right to pursue legal claims against the above-named individuals and entities.

6. SEVERABILITY
I agree that this waiver is intended to be as broad and enforceable as allowed under Georgia law. If any portion is held invalid, the remainder shall remain in effect and interpreted to maximize protection for the released parties.

I am the parent and/or legal guardian of the above-named minor participant. I have read this agreement thoroughly and understand all of the terms. I understand that I am surrendering legal rights on behalf of the minor and myself. I, on behalf of myself and my minor, agree to be bound by all of the terms of this agreement and also give my consent to allow my minor to participate in the Activities described herein. I release and agree to indemnify and hold harmless the Releasees from any kind and all liabilities incident to my minor child’s participation in these programs as provided above, even if arising from the negligence of the releases, to the fullest extent permitted by law.
